The Roost: Boiler MACT Update for North Carolina

Since vacatur of the Boiler MACT in June 2007 there has been considerable disagreement over applicability of case-by-case MACT standards for boilers under Section 112(j) of the Clean Air Act. The State of North Carolina has taken the position that the vacatur triggered 112(j) requirements, and the Division of Air Quality is proceeding to process 112(j) applications. DAQ’s actions present a valuable opportunity for operators of affected boilers. This action applies to all boilers at major sources of hazardous air pollutants in North Carolina.
