ACE Committee Meeting: A First Look at the New Boiler MACT

The Boiler MACT is the most far-reaching of all MACT rulemakings. It is estimated to affect 1,370,000 boilers at small, “area” air emission sources, and 58,200 boilers at major air emission sources. The breadth and potential financial impact of the rule is evidenced by significant litigation and negotiation surrounding almost every aspect of the complex regulatory development. The original Boiler MACT was vacated by the DC Circuit Court in 2007, and the EPA is on track to propose a new rule on April 21, 2010.

This important Ace Committee meeting focuses on potential impacts of the proposed new rule to AHFA member companies. Compliance alternatives and identifying which aspects of the rule are reasonable, and which aspects appear to impose significant cost for minimal environmental benefit are discussed. The legal and technical presentations are followed by a working session to develop industry comments to the proposed new rule.
